Proposed Changes to Local Rules

The U.S. Bankruptcy Court for the Southern District of Alabama is considering proposed changes to its local rules.  The proposed Local Bankruptcy Rule 2004-1 is new and is based on a local rule in the Middle District of Florida.  It eliminates the need for a motion and order to initiate a Rule 2004 examination.  It also provides procedures to provide notice of the examination or move for a protective order.   The proposed amendments to Local Bankruptcy Rule 3015-2 incorporate changes to the chapter 13 confirmation procedure that have been made by local Administrative Orders 2021-6 and 2022-1.  The amended rule also omits a change in plan term or payment as requiring an amended preconfirmation plan.
