The Eleventh Circuit has approved the proposed local rule changes which were circulated earlier this year. Local Bankruptcy Rule 2004-1 is new and provides for the examination of debtors and others in bankruptcy cases other than AP’s by notice instead of motion and order. When the changes go into effect on September 1, the court will delete the ECF event for a Rule 2004 motion and create one for a Rule 2004 notice of examination. The amended Local Bankruptcy Rule 3015-2 is more specific as to when an amended chapter 13 plan is required preconfirmation and what service on creditors is required for postconfirmation modifications. The amended rules can be found here.
